    At first glance it is easy to dismiss The Turning Point in Private Law by Ugo Mattei and Alessandra uarta as ideologically fueled and near propagandist Indeed the language used throughout the book is at times indistinguishable from that of political manifestos As someone not entirely of the same belief system regarding private law this posed an initial obstacle to a full appreciation of the concepts being discussed The common thread woven through each chapter of this book and one with which I find myself in full agreement is that private law as it currently stands does not take into account the impact that its movements has on the full scope of stakeholders In the realm of property law this is demonstrated through the principle of exclusion upon which the idea of ownership of property is premised By expanding this view to the co existence of exclusion and access a inclusive and societally beneficial model of private property can be developedAs a whole this book was a jarring read I have always thought of my previous institution of education as being ideologically neutral if not only slightly right leaning in its approach to private law In matters of public law our pedagogy was undoubtedly left wing This is of course to be expected from a country still feeling the burn of its historical right wing social policies It was in this reading however that I learnt that this perception was incorrect I was taught to view and indeed to uphold the individualistic approach to contract law the idea that contracts existed in a kind of vacuum – that the only parties affected by a contract’s negotiation and conclusion were those that signed their name at the bottom of the page Logically it is clear that this idea is flawed yet it was simple enough that it took root and indeed was taught in such a way that we studied the idea of a contract its formation and all of its technicalities in extreme detail negating in its entirety any kind of further societal and ecological analyses As a lover of this field of law this book therefore helped me understand that while contract law is not evil it can be used and taught in a way that perpetuates evil in our society In essence my belief system is less geared towards a deconstruction of the current paradigm but rather towards a reformulation; as suggested in The Turning Point “People can become commoners by proper private law incentives”
